These Terms and Conditions govern your use of the Nesthopping platform. By creating an account or using our services, you agree to be bound by these terms.
Nature of the Service
Nesthopping provides a private technology platform for approved members to create profiles, discover homes, contact other families, and coordinate possible exchanges. Nesthopping is not a party to any exchange agreement between users. Nesthopping does not act as a real estate agent, landlord, host, guarantor, bank, or payment entity.
Eligibility
You must be at least 18 years old to use Nesthopping. You must provide truthful and up-to-date information, have sufficient right to offer the home described, and comply with applicable local laws, community rules, insurance, lease agreements, homeowners' association rules, and tax requirements.
Membership, Renewal and Cancellation
Membership is available as a monthly or annual subscription, billed at the rate displayed before payment. The membership renews automatically unless you cancel. You may cancel at any time from your account settings or by contacting support. Cancellation preserves access until the end of the current paid period, unless your account is suspended for a serious violation. No Deposits or Fund Custody
Nesthopping does not request, hold, block, manage, or release security deposits. Any external financial agreement between users is outside of Nesthopping and carried out under the sole responsibility of those users. Users must not present Nesthopping as a guarantor, financial mediator, fund custodian, or party responsible for damage compensation.
Exchanges Between Users
Exchanges are peer-to-peer agreements between members. Each user is responsible for verifying identity and expectations, confirming legal or contractual permissions to exchange their home, maintaining adequate insurance, and reviewing travel, health, pet, child, accessibility, and local regulation risks. Nesthopping may offer community agreement templates, but these are operational aids and do not replace legal advice.
Moderation and Safety
Nesthopping may review profiles, homes, messages, or activity when necessary for safety, compliance, support, or fraud prevention. We may reject profiles, remove homes, suspend accounts, or limit features if we detect risk, abuse, false information, spam, discrimination, harassment, fraud, or rule violations. When content is removed or an account is suspended, the user will receive a reasonable explanation unless doing so would compromise safety, investigation, or legal compliance.
Disputes
Nesthopping may facilitate communication or review abuse reports, but does not adjudicate damages, charge penalties on behalf of users, or guarantee financial recovery. Material disputes about damages, breaches, injuries, lost items, permits, or taxes are the responsibility of the users and the applicable legal and insurance channels.
Limitation of Liability
The service is provided as-is and as-available. To the extent permitted by law, Nesthopping is not liable for the conduct, omissions, or statements of other users; property damage, injuries, theft, or losses; cancelled trips, unmet expectations, or personal conflicts; lack of user insurance coverage; or tax, zoning, lease, or regulatory consequences of an exchange. Total liability is limited to the membership fees paid by the user in the 12 months preceding the claim.
Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must not share your account with another person, transfer it, or allow anyone else to access the platform using your credentials. Each person must have their own account. If you suspect unauthorized access, notify us immediately at support@nesthopping.homes. Creating multiple accounts per person is prohibited and will result in suspension of all related accounts without refund.
Prohibited Uses
You may not use Nesthopping to: list a home you do not have the right to offer; use exchanged homes for commercial subletting, short-term rental arbitrage, or any revenue-generating purpose; create multiple accounts to game NestCredits, referral programs, or circumvent a suspension; scrape, crawl, or systematically extract data from the platform; reverse engineer, decompile, or attempt to extract the source code of the platform; impersonate another person or misrepresent your affiliation; use the platform for advertising, solicitation, or marketing; attempt to interfere with the proper functioning of the platform; share your account access with non-members; or coordinate sham exchanges to manipulate rankings or credit balances. Violation of any prohibited use may result in immediate suspension without refund.
User Content
You retain ownership of content you submit (photos, descriptions, messages). By submitting content, you grant Nesthopping a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content solely for operating and promoting the platform. You represent that you have the right to submit the content and that it does not infringe any third party's intellectual property, privacy, or other rights. Nesthopping may remove content that violates these terms or applicable law. You must not copy, download, or redistribute other users' photos, descriptions, or personal information for any purpose outside the platform.
Nature of Exchanges
Exchanges arranged through Nesthopping are temporary, voluntary, peer-to-peer arrangements between members. An exchange does not create a tenancy, lease, rental agreement, sublease, license to occupy, or any landlord-tenant relationship under any jurisdiction. Participants are guests, not tenants, and may not assert tenant rights, occupancy protections, or eviction-process requirements in connection with an exchange. If local law requires specific formalities for temporary home exchanges, compliance is the sole responsibility of the participating users.
Indemnification
You agree to defend, indemnify, and hold harmless Nesthopping, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: your use of the platform, your conduct during an exchange, your breach of these terms, your violation of any law or third-party rights, content you submit, or any dispute between you and another user. This indemnification obligation survives termination of your account.
Termination
We may suspend or terminate your account at any time if you violate these terms, engage in fraud or abuse, pose a safety risk, or for any reason with reasonable notice. Upon termination for cause, you are not entitled to a refund of any membership fees. If you have active exchange agreements at the time of termination, you remain responsible for your obligations under those agreements. You may terminate your account at any time by canceling your subscription and contacting support. Fraudulent chargebacks against legitimate membership charges constitute grounds for immediate termination and Nesthopping reserves the right to pursue recovery of the disputed amount.
Force Majeure
Nesthopping is not liable for any failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, war, terrorism, power outages, internet disruptions, cyberattacks, or labor disputes. During such events, affected obligations are suspended for the duration of the event.
Governing Law and Jurisdiction
These terms are governed by the laws of Spain. Any disputes arising from or relating to these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain, except where mandatory consumer protection laws of your country of residence provide otherwise. Nothing in this clause limits your right to bring proceedings in the courts of your habitual residence if required by applicable EU consumer protection regulations.
General Provisions
If any provision of these terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force. Our failure to enforce any right or provision does not constitute a waiver of that right or provision. These terms, together with the Privacy Policy, Community Standards, and Membership and Refund Policy, constitute the entire agreement between you and Nesthopping regarding the use of the platform, superseding any prior agreements.
Changes to These Terms
Material changes will be communicated with reasonable advance notice. You can always review the current version and its effective date on this page. If you do not accept material changes, you may cancel your membership before they take effect.
